Limited Product Warranty (“Warranty”)

Products (as defined below) made by Giardini di Toscana S.r.l., with registered office at Via XXVIII Agosto 75, 52011, Bibbiena (AR), Italy, VAT n. IT02264320512 (“Giardini di Toscana” or “Company”) are crafted in Tuscany, Italy, with the finest raw materials and strict quality controls. To guarantee that our Products reach you in good condition - authentic, fresh, and properly stored - the Company provides this Warranty exclusively for Products purchased from Giardini di Toscana directly (via our website: giardiniditoscana.com) or from our Authorized Retailer (as defined below).

 

a)     “Authorized Retailer”: refers to the carefully selected Authorized Retailers through which the Company sells exclusively. To verify whether a seller is authorized, or if you have questions, contact us at: clienti@giardiniditoscana.com

b)     “Products”: means authentic products manufactured and sold by Giardini di Toscana, including but not limited to: eaux de parfum, body creams, home fragrances, discovery kits, customizable kits, and other items bearing the Giardini di Toscana trademark, but EXCLUDING testers, samples, vials, gift wrapping, separately sold accessories (applicators, atomizers, caps/stoppers), and products marked "Not for Sale," "Sample," "Evaluation," or "Demonstration."What This Warranty Covers

 

This Warranty applies to all Products purchased from Giardini di Toscana or an Authorized Retailer. The Company warrants that such Products are:

a)     authentic Giardini di Toscana products;

b)     free from defects in materials and workmanship at the time of delivery;

c)      manufactured, stored, and transported in accordance with our quality standards.

 

"Warranty Period" means 90 days from the date you discover the defect, or 12 months from the date of delivery, whichever is earlier.

 

If a Product is found to be defective during the Warranty Period, the Company will, at its reasonable discretion and in accordance with applicable law, provide one of the following remedies:

 

1. Replacement of the defective Product at no cost to you (including return shipping);
2. Repair of the defective Product at no cost to you;
3. Refund of the purchase price.

 

How to Make a Warranty Claim

To make a warranty claim, you must:

1.      Contact the Company within the Warranty Period at clienti@giardiniditoscana.com with:

a)     Proof of purchase (order confirmation, invoice, or receipt from Giardini di Toscana or an Authorized Retailer);

b)     Clear photographs or detailed description of the defect;

c)      Your order number and product batch code (if available);

d)     Date of purchase and date the defect was discovered.

2.      The Company will evaluate your claim and determine whether the defect is covered.

3.      If approved, the Company will arrange remedy (replacement, repair, or refund) at no cost to you, including return shipping.

 

EXCLUDED DAMAGES & CONDITIONS:

This Warranty does NOT cover:

 

a)     Products purchased from unauthorized sellers, including unauthorized third-party sellers on online marketplaces such as (but not limited to) Amazon, eBay, Walmart Marketplace, or any other marketplace not officially authorized by Giardini di Toscana;

b)     Products with removed, altered, or defaced batch codes, labels, or packaging;

c)      Products purchased second-hand, as "used," "opened," "decanted," "repackaged," or from unauthorized resellers;

d)     Individual vials or components separated from discovery kits or other bundled sets;

e)     Damage caused by:

1)     Misuse or use inconsistent with product labeling and instructions;

2)     Improper storage, including exposure to extreme heat, cold, humidity, or direct sunlight;

3)     Normal cosmetic aging or wear;

4)     Accidents, negligence, or willful damage;

5)     Modification, repair, or tampering by anyone other than Giardini di Toscana;

6)     Failure to follow product storage, handling, or application instructions provided on the product label, packaging, or our website;

f)       Claims made outside the Warranty Period (more than 90 days from discovery of defect or more than 12 months from delivery, whichever is earlier).

Why this matters:

Unauthorized sellers are not subject to the Company's quality controls. Products sold through unauthorized channels may be expired, diluted, improperly stored, damaged, or counterfeit, and Giardini di Toscana cannot vouch for their authenticity or condition. Such products are materially different from genuine Giardini di Toscana products sold through authorized channels.

 

Limitation of Liability & Exclusion of Damages

TO THE EXTENT PERMITTED BY APPLICABLE LAW Giardini di Toscana's total liability for any claim arising out of or related to this Warranty shall NOT exceed the purchase price paid by you for the Product in question.

IN NO EVENT SHALL GIARDINI DI TOSCANA BE LIABLE FOR:

a)     Indirect, incidental, consequential, special, or punitive damages;

b)     Loss of profits, loss of use, loss of data, or business interruption;

c)      Loss of revenue, goodwill, or reputation;

d)     Costs of replacement goods or services;

e)     Any other damages, whether direct or indirect, arising from the use of or inability to use any Product.

This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, EVEN IF Giardini di Toscana has been advised of the possibility of such damages.

Your Legal Rights

This Warranty gives you specific legal rights. You may also have other rights depending on your location.

For Consumers in the European Union:

Nothing in this Warranty affects, limits, or replaces the statutory legal guarantee of conformity provided by EU and national consumer law (including but not limited to the Consumer Rights Directive 2011/83/EU and related national implementations). EU consumers retain all statutory rights to repair, replacement, price reduction, or contract termination under applicable law, independently and in addition to this Warranty. In the event of conflict between this Warranty and mandatory EU consumer law, the more protective provision applies.

For Consumers Worldwide:

This Warranty applies to all Products purchased from Giardini di Toscana or an Authorized Retailer, regardless of location. If local consumer protection laws provide stronger protections than this Warranty, those protections apply.

 

Disclaimer of Warranties

EXCEPT AS EXPRESSLY SET FORTH IN THIS WARRANTY, GIARDINI DI TOSCANA MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR SATISFACTORY QUALITY.

All Products are provided "AS IS" except as expressly warranted herein.

To the extent any implied warranty cannot be excluded under applicable law, such warranty is limited in duration to the Warranty Period stated in this Warranty.

 

Governing Law & Dispute Resolution

This Warranty is governed by:

• For U.S. Consumers: The laws of the State of California, without regard to conflict-of-law principles.
• For EU Consumers: The laws of Italy, without regard to conflict-of-law principles. Disputes shall be subject to the non-exclusive jurisdiction of Italian courts.
• For All Other Consumers: The laws of Italy apply.
